What Is Cruel And Unusual?

Today, Supreme Court Justice Anthony Kennedy allowed a convicted murderer a last minute stay of execution while they tackle the issue of whether the lethal injection he is to receive is cruel and unusual because it causes pain to damaged veins. The murderer, Clarence Hill, does not have damaged veins but the claim that it causes pain to those who do was enough to spare him, for now. Hill shot and killed a police officer during a robbery. I am going out on a limb here and saying that the Police Officer suffered pain as a result of the gunshot. I will carry that a bit further and say that the family of the slain officer still feels emotional pain. Anthony Kennedy increased that pain by stopping the execution.

Let us look at a few things. This same Supreme Court ruled that it was OK for physicians to assist in the suicide of patients with terminal diseases. Anthony Kennedy was in the majority on that decision. How can he say it is OK for patients to receive lethal injections but it is cruel and unusual for a criminal? I would argue that he said it was not unusual when he allowed it for patients. As for cruel, I find it hard to believe that it is cruel for a criminal to feel a little pain just before he dies. From what I have heard, they get sedatives before they are killed so it is unlikely they actually feel much pain. In the long run, does it really matter when we are ending their miserable lives?

Can someone explain how Kennedy decided this? Is anyone able to explain the rationale for this kind of boneheaded decision? Is this the kind of “mainstream” that Ted Kennedy, Joe Biden, Chuck Schumer, and the rest of the donks want our judges to be like? Isn’t this the kind of decision they were worried about Alito making? Taking radical positions against the wishes of the states and the people? The people have decided that this murderer is to be put to death. In all reality, I can not think of a method that would absolutely guarantee there would be no pain. But I am absolutely sure that this is a hell of a lot less painful than being hanged or electrocuted.

Isn’t it nice that we have a society where a person can brutally murder someone and we get our panties in a wad about whether they will feel pain when they receive their just punishment?
