McCain Can’t Let Go

Senator John McCain had earlier indicated that he would not run for reelection in 2016 when his current six year term is up. The grumpy old man seems not to be able to let go of power or perhaps he is having too much fun ruining the country because he is now indicating he will run again.

“I’m seriously thinking about maybe giving another opportunity for you to vote for or against me in a few years from now,” McCain said on KFYI-AM in Phoenix. “I’m seriously giving that a lot of thought.” Washington Post

Dear John, do the nation a favor and retire. You will be 80 years old in 2016 and you should spend your time lashing out at neighborhood children for walking on your lawn instead of playing video games in the Senate. Hell, think about it John, you could retire and play all the video games you want without worrying the media will snap photos of you doing it.

You are no longer needed. In fact, you are at least 20 years past your best by date. Yes John, I voted for you in the 2008 presidential election but that was because I like Sarah Palin. She is a conservative. Look it up John so you know what it means.

You have failed your state and you have failed your country with your spineless retreat from Obama and his regime. You are part of the problem and not part of the solution.

Please, leave for greener pastures and let the real leaders like Mike Lee and Ted Cruz get something done without your perpetual interference.

People of Arizona, if McCain runs for reelection please do your state and the nation a favor and vote him out of office.

The Senate does not need another doddering old fool drooling in the corner waiting for a diaper change while flinging poo at the real leaders.

Politicians, You Were Warned

It looks like Democrats, with the help of some RINOs will be able to find a way to fund Obamacare against the will of the people and, in the case of Republicans, in opposition to the position they ran on. These Republicans vowed to do everything possible to defund of repeal Obamacare. They have the chance and they are not going to do it.

The Republicans who help the Democrats will then vote against the measure which will pass with a simple majority which the Democrats have. Those deceitful Republicans will then run for reelection telling people they voted to defund Obamacare and that will be a lie.

Americans were given over 21 hours of education by Senator Ted Cruz and he made it clear that a vote for cloture would be a vote for Obamacare.

The American public has been burning up the phone lines to the Capitol and expressing their desire that their Senators do what it takes to defund.

The people in the Senate, those who work for us, will ignore them at their own peril. When 2014 rolls around these same politicians will run around begging for money, swearing they kept their promise to defund and will ask that you vote for them so they can continue their work.

Many of them will lose their seats either in a primary or in the general election because the base is fed up. We know what they are doing and we know they are lying to us. For those who were unsure Ted Cruz spelled it out very clearly. You can play games but you do so at your own peril.

Mitch McConnell lost the Tea Party backing and he has a primary opponent. It is time for the people of Kentucky to throw this hack out of office. If John McCain does not retire then the people of Arizona need to retire his sorry ass.

We need to make them pay for failing to listen to us.

I do not care if the Democrats take control. That is not my concern because with this bunch of Republicans we might as well have Democrats.

The Republican Party will be making calls to get money for the election. Some of my money will go to specific candidates like Cruz and not to the parties. I recommend that people use their political donations to buy ammo instead…

There is a good chance the Republican Party will lose many people who will change their affiliation over this.

Good, let them ride the sinking ship to the bottom without the rest of us.

Congress Will Use End Run, Deceive On Immigration

With the Obama regime neck deep in scandals, all of which are real and deserve scrutiny, the Senate is forging ahead with immigration reform. Read that as backdoor amnesty because Senators from both parties are working on ways to promise us one thing and do another. They are also working to pass as much as they can while our attention is focused on the Obama criminal regime.

The Senators keep telling us that these illegals will not be allowed to get taxpayer funded assistance. No welfare for them when they come out of the shadows. This is absolute BS.

First of all, the Senate Judiciary Committee has passed an amendment to the immigration legislation that will allow illegals who are magically changed to legally here eligible for welfare.

Even if this were not the case they would still get it. How is that, you ask?

Quite easy! Under the misinterpreted and misapplied 14th Amendment any child born here to these illegals will be called a US citizen. The parents, though illegal, will apply for any benefits that a child who is a US citizen can get. These people will have welfare rolling in and spend it on whatever they want (they do this now so how will it be any different when we make them legal). Those who claim that they will get no welfare will then tell us that those kids are citizens and “deserve” this.

No, we did not lie because citizens are getting your money, not those illegals we waved our amnesty wand over.

The liberals in the Senate have already balked at removing the eligibility for the Earned Income Credit (EIC) on their taxes. This credit is a wealth redistribution scheme where people who pay no taxes (or very little that they usually get back) get money because they have children. It is a scheme that allows those who pay no taxes to get what was withheld back AND THEN SOME.

The Senate passed the amendment allowing welfare so it matters not but regardless of how they approach this, the illegals will be getting taxpayer money. If that is not bad enough, the alleged fines these people will have to pay (as in fines and back taxes) is all a ruse.

As pointed out, they pay little or no taxes. How can we force them to pay back taxes when they end up not having owed any taxes? No, this is all smoke and mirrors so the government can claim that these people paid their dues.

No restriction is allowed on all of these lawbreakers. The advocates for these illegals are screaming about an amendment making conviction of a third DUI grounds for deportation. No, we can’t have such a strict thing for people whose first act in this nation was to break our law.

Look, these folks can be wonderful and hard working pillars of their shadow communities but the reality is that they are all lawbreakers. They came here illegally and now want to be rewarded for their crimes. They expect special treatment over those who are trying to do things the right way.

I personally have a friend who is highly skilled and has a job offer pending at a hospital but she cannot get here because of all the illegals and non English speaking people gumming up the works. She has been waiting for years to come here and she would be an immediate asset. She is skilled in a profession that is in short supply and she has a job offer. She would start working and begin paying taxes immediately.

But she can’t come here because of all the future Democrat voters who are demanding they be rewarded for breaking the law and because liberals in Congress are listening to them.

We need to put systems in place to flush these folks out where they self deport or we send them packing and we need to change our laws so that those who try to come here the right way AND HAVE SOMETHING TO OFFER are processed quickly.

We conservatives are not against immigration. We are against illegal immigration.

We are also against members of Congress who pander to people who break the law and expect to be rewarded for it.

I have an idea. Let’s evict the United Nations, tear down the building and ship the bricks to the south. Then round up the illegals and make them build a wall between them and the US with those bricks. Once it is done we will let them walk back home without being put in jail. In exchange for their labor we will allow them to apply for legal entry in 15 years, may never become a citizen and may never vote in an election.

Even Democrats won’t want them here if they can’t vote.

Any Doubt Obama Is Harming People On Purpose?

The battle of the mindless in DC continues to go back and forth as Barack Obama fights to avoid HIS sequestration. Yes, he wanted it; he suggested it and he got it. Now he is running around pointing fingers and trying to avoid it like the plague. Obama does not negotiate in good faith. In fact, none of the Democrats do. Their idea of negotiating is to demand tax increases NOW and spread cuts (cuts that NEVER happen) over ten years.

Obama got huge tax increases in December and cutting was supposed to take place between then and now. However, Obama has decided that the way he wants to proceed is to raise taxes again. He does not want to cut so he is placing the burden of the sequester cuts on people who will feel them.

I wrote yesterday that Obama must cause pain or people will realize that cutting is not so bad. There is, as of today, no doubt he wants people in pain if he cannot have his tax increases.

[note]The cuts are only to the growth in government. We will spend more this year than last and we spent more last year than the one before. This is a cut in growth, not an actual cut to the budget (which, by the way, they have not had for over 4 years).[/note]

The Republicans in the Senate have come up with a plan that eases the restrictions and allows Barack Obama even greater latitude to decide where the 85 billion dollars in cuts will come from. In other words, they will allow Obama to decide what to cut so long as it adds up to the right amount. Obama could take this on, cut from things that do not directly affect people, and reduce the pain.

But he does not want to do that because no pain means people will realize that government must spend too much and we can cut even more. This puts a damper on his plan to grow the government and create more dependency than we currently have.

To Obama government is everyone’s mommy and daddy and he can’t have people seeing that they can live with less of it…

Obama has threatened to veto the Senate Republican bill.

He does not want the ability to cut from larger sources because it would ruin his plans. Obama said that the only way to solve the problem is to back the Democrat plan of raising taxes on the wealthy (who cannot solve it even if all their money was confiscated) and then cut over ten years. That is the liberal playbook. The other part is they will never cut but the taxes will stay in place. It has been done time and again and Democrats never keep up the cut part of the equation.

Pretty much like they are trying to do now in their effort to avoid the sequester.

Obama also indicated that there is NO WAY to cut 85 billion dollars over the next seven months (the balance of the fiscal year) without drastically affecting national security and economic policies.

Really? Cuts need to happen and entitlement programs need to be reformed. I know liberals like to scream about the wars Bush started and the amount of money they cost but entitlement programs cost 2.48 TRILLION dollars. The war on terror cost 115 BILLION dollars. Entitlements need to be reformed and there is an abundance of waste in them. Government wastes BILLIONS of dollars each year sending money to people who should not get it, like dead folks. The Medicare system is rife with fraud and costs billions of dollars that government is unable to catch.

But we need cuts now and Obama needs to get to 85 Billion. Here is an idea. Let’s cut the 24 BILLION dollars that we spend on foreign aid. Most of the places we send it don’t like us anyway and hell, we need to take care of our own first. Why should people in the US be harmed so some jihadist Muslim nation can get billions in aid?

There are billions of dollars in accounts at various agencies that have not been spent. The money is excess and could be used for the cuts. There are also hundreds of programs that do the same thing. We can cut them and have one agency in charge (if the program is actually needed). There is no doubt that billions of dollars are wasted each year on things like turtle tunnels and what we can learn about democracy from fish so let’s cut them.

It will not take long to get to and surpass 85 BILLION dollars. All Obama has to do is want to do it.

And that is the rub. Cutting the money would be easy but then he would lose his claim that government needs more money and the cuts will harm people. He will lose his ability to grow government and show that his claim that we don’t have a spending problem is a lie

Senator Barbara Mikulski of the People’s Republik of Maryland mocked claims that we should be able to cut 2% like families have to do. She said that American families don’t run prisons, don’t build roads and don’t have to fund their own local police force.

First of all, American taxpayers do have to pay for all of this IN ADDITION TO PAYING FOR THEIR OWN BUDGETS. Second of all, the federal government does not do all of this. Local roads, prisons and police forces are paid for by local (including state) governments with taxes confiscated from taxpayers in those states.

The federal government is not as involved in all of this as she would have us believe. Additionally, government historically takes the money taxpayers have confiscated for these things and spends it on other things. In Maryland we had a transportation fund that had lots of money in it that we paid in. The Democrats spent it on other things and now want to tax us even more to fund transportation. This happens at the federal level as well. Let us not forget that Social Security has had trillions of dollars paid in since it was started. There is no money for that program because politicians used it in the general fund. Now we have to pay more in to replenish the money. We are paying for it at least twice.

So Mikulski can take her mocking tone and put it where the sun does not shine. She is part of the problem and she takes the rest of us for idiots who do not see what is really going on.

Obama’s end game is to hurt as many people as possible to push his agenda. Mikulski’s game is to help him do it.

They are evil people who must be stopped.

What About That Pesky Constitution Confuses Obama?

King Barack Hussein* made a few appointments by declaring that the Senate was effectively in recess so he had the authority to do so. His mouthpieces claim that the White House Legal Council has reviewed the issue and said it was OK for King Hussein to make the appointments. Interestingly, the Department of Justice is the agency that normally reviews items of Constitutionality. I imagine that Hussein figured that his Council could say it was OK and then after the fact he could persuade his buddy Holder to write a favorable opinion.

The rule of law. Hussein said the Senate was effectively in recess for weeks so he could make the appointment because the Constitution says so. If Hussein wants to be technical, let us do so. My well worn pocket Constitution, Article II, Section 2, last paragraph reads:

The President shall have the power to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their next Session. [emphasis mine]

So let us assume, for a moment, that Hussein is correct about the Senate being in recess. Technically, the vacancies DID NOT HAPPEN during the alleged recess. The Constitution is clear in that the President may fill a vacancy that occurs while the Senate is in recess. These vacancies have been present for quite some time and DID NOT occur during the recess Hussein claims exists.

Therefore, he had no authority to begin with regarding making the appointments. This will likely go to court and it would be great if a ruling came down expressing exactly what the Constitution states and thereby prevent Congress and presidents from playing games regarding appointments. If the vacancy did not occur during a recess the president cannot fill it, period.

Let us suppose that a court does not rule this way (and some past rulings might run counter to it). Referring to my trusty Constitution, I see this under Article I, Section 5, Paragraph 2:

Each House may determine the Rules of its Proceedings, punish its Members for disorderly Behavior, and, with the Concurrence of two thirds, expel a Member.

The US Senate has a website that spells out what a pro forma session is and how it relates to the last paragraph of Section 5. That section reads:

Neither House, during the Session of Congress, shall, without the Consent of the other, adjourn for more than three days, nor to any other Place than that in which the two Houses shall be sitting.

And the Senate site explains it this way:

This section was included to prevent either chamber from blocking legislation through its refusal to meet. Each chamber takes very seriously its independence of the other body. To avoid having to ask the other chamber for permission to adjourn, the Senate and House simply conduct pro forma (as a matter of form) sessions to meet the three-day constitutional requirement. No business is conducted at these sessions, which generally last for less than one minute.

Additionally, the Senate explains that pro forma sessions occur, last a few minutes, and no business is conducted:

Pro Forma Session: A pro forma session is a brief meeting (sometimes lasting only seconds) in which no business is conducted. It is held usually to satisfy the constitutional obligation that neither chamber can adjourn for more than three days without the consent of the other.

There is no doubt that pro forma sessions are part of business and are recognized as such. It is also evident that they are held so that one chamber does not have to ask the other to adjourn which means they have NOT adjourned. The methods for recess in the Senate are as follows:

In the Senate, the Chair has no inherent authority to declare recesses. Recesses are accomplished only (1) by the full body giving unanimous consent to hold recesses “subject to the call of the Chair,” or (2) by adopting a motion to recess, offered by any Senator from the floor. Wiki Answers

The best I can figure from reading the Congressional Record for the month of December (you have to search with the month parameters), the Senate did not motion for a recess and has been adjourning every three days. I also note that some of the Senators who held the sessions were Democrats. It is possible the Senate adjourned three days at a time because the House was still in session debating the tax cut extension and the Senate did not want to ask permission to adjourn (under the Constitution) so it held pro forma sessions and most Senators left town. Since they never adjourned a quorum to motion for a recess they have been in pro forma sessions every three days. It is interesting to note that the Senate did this because it was unlikely the House would have granted permission to adjourn. It wanted to remain and hash out the tax cut bill. The Senate passed its version and did not want to stay so it used pro forma sessions to avoid having to ask. The leadership of the Senate (Democrats mind you) is responsible for the Senate not being in recess. Don’t expect to see this on the liberal media. They have to blame it all on Republicans.

There is not doubt that these kinds of sessions are the practice of the House and Senate as part of their procedures (procedures they are Constitutionally authorized to enact) so I cannot see how King Hussein is able to do a recess appointment. He does not get to decide if they are in recess or not, they do.

So it looks like Hussein has bombed on several issues of the Constitution. Wasn’t he allegedly a Constitutional law professor?

Of course I am no lawyer and this will have to be settled in the courts. No matter how it all turns out things are going to get uglier than they already are, if that is even possible.

I believe, as do many who have looked at this, that King Hussein has overstepped his authority and has usurped the Constitution.
