Time To Pull The Plug On Obamacare

This week will be full of back and forth fighting over Obamacare and the budget. Conservatives are trying to defund Obamacare while providing funds for all the rest of the government but Barack Obama and his henchmen in the Senate are holding the country hostage over the failed legislation. Those of us affected by it are in the dark

A huge majority of Americans does not want Obamacare and they want to be left out of it. Obama and the Democrats (as well as obedient establishment Republicans) are ignoring the will of the people and threatening to shut down the federal government if they do not get their way.

These people want to ignore the majority of Americans on this issue and impose this on them against their will.

Interestingly, Democrats think we should follow the majority opinion when it involves something they want. They falsely claim that a majority of Americans want the gun control they are pushing (this is untrue) and use that alleged support as a reason to impose unconstitutional restrictions upon us.

When the majority actually does favor something (like getting rid of Obamacare) they ignore the will of the people.

Obamacare is a failure, period. More than half of the lawful deadlines have been missed and Barack Obama has illegally changed the law to benefit businesses and his buddies (the Executive cannot change a law unless there are provisions for the changes in the law, otherwise, only the Legislative can change the law).

Obamacare is so great that Obama has exempted a great number of organizations who do not like it (most of whom supported it). The law has even been changed in order to keep Congress and Congressional staffers from participating.

The law they passed is good enough for YOU but not for them. Democrats are fighting attempts to ensure the law is followed and that Congress is not exempted and they are receiving help from Republicans who do not want it either. I do not blame Republicans for not wanting it because none of them voted for it. However, the law is the law and if it passed and must be followed by the rest of us then they should not be exempt.

I feel sorry for the millionaires in Congress who can’t afford health insurance on over $170,000 per year but they are just going to have, to quote Obama, to eat their peas.

Efforts to ensure Congress must follow the law are also aimed at Chief Justice John Roberts. People want him to have to be in Obamacare since he ruled it Constitutional (actually he changed the law by rewriting it which is not the job of the Legislative Branch).

It appears as if the people who work for us are having trouble doing the jobs they are authorized to by the Constitution and are too busy involving themselves in things they do not belong in.

The Republicans can defund this. If the Senate will not get on board then the House should send single bills to fund other parts of government. The first one should be for Defense to ensure the soldiers get paid (Social Security is on autopilot so people will get their checks). Let the Senate vote that up or down.

Then the House can do that with each other part of government covered in the entire budget. They can make it so nothing can be added to it because it will be a single budget item.

Let Democrats vote each item of the government up or down and hold them accountable.

If Obama vetoes any item then hold him accountable.

These folks are playing games and we are the collateral damage of their petulance.

I know that the brain dead witch Pelosi said there was nothing else to cut from the budget but if they hire me, give me the budget and two months I will have cuts for them.

And since I am not in elected office I can’t be swayed by the desire to get reelected…

Did Obama Win The Battle Only To Lose The War?

Last week the Supreme Court ruled that Obamacare can stand but only after the Judicial Branch majority became legislators. The Court basically rewrote the law that Congress passed and inserted the word TAX to replace the word PENALTY. This flies in the face of everything the left has been saying about the law. Obama emphatically denied that the penalty was a tax. Now that the Court has changed the law the reality is that Barack Obama broke his promise not to raise taxes on the middle class.

When all is said and done Obamacare will impose nearly a TRILLION dollars in taxes on Americans. Keep in mind, this is not an income tax it is a tax on something other than income. Some of the tax increases will pay for the massive expansion of government but the most onerous tax is the one where a person pays a tax for doing absolutely nothing. I have seen in several places an imaginary exchange that highlights how this works:

CUSTOMER: No thank you, I would NOT like a pack of gum.
CLERK: OK, the tax on that will be $2.35.

If Americans ever went to a store and declined to buy something and were forced to pay a tax for doing so they would be marching on DC with pitchforks and torches and lynching those in Congress.

But the very same thing has taken place under the health care law. If you report that you do not have health insurance (whether you can’t afford it or declined to buy it) you will have to pay a tax. This is a nightmare for Obama and I think he would have rather had the mandate ruled unconstitutional than have it upheld as a tax because now he has to defend breaking his promise. Remember, the taxes on the middle class would not be raised one dime, per Obama.

Obama and his sock puppets are already trying to rewrite the SCOTUS decision that involved rewriting the law. They are out saying that this is not a tax and is a penalty. Sorry liberals, you cannot have it both ways. If you are going to implement Obamacare because the Court ruled in your favor then you have to implement it based on the ruling.

This is not an accident. The New York Times has described this as a penalty and made the claim that the SCOTUS upheld the penalty.

WRONG. IT IS A TAX – PERIOD.

It is the largest tax increase in our history and it demonstrates that Barack Obama is a tax and spend liberal and nothing more.

While he is out saying the ruling is a win for the middle class the reality is that the middle class will get hit hard by the taxes. Wealthy people, by and large, have health insurance so they will not be affected by the tax for not having it. Those who cannot afford it will get screwed and they will pay other taxes to fund the monstrosity as well.

This is by no means a win for the left no matter what they claim because the ruling allows several things to take place. It allows states to opt out of the Medicaid expansion (which will leave a lot of poorer folks with no insurance and a tax for not having it) which is a big deal. The ruling also allows any future Republican majority in the Senate to repeal the law with a simple majority of 51 votes. Because this is now a TAX issue it will only take 51 votes to repeal it.

The ruling also had some intangible benefits. It has motivated a huge segment of society that now knows the only way to repeal Obamacare is to get rid of Obama and get a majority in the Senate (assuming the majority in the House holds). Around 66% of Americans disapprove of Obamacare and those people will be out in force on election day. They will be out to repeal Obamacare via the ballot box because the system of government that the Founders gave us failed them when an activist Court rewrote a law to make it Constitutional.

John Roberts might have felt he had to do this to preserve the integrity of the Court (though I fail to see how that happened) but he was wrong in what he did. I know, he has the law degree and he is the highest judge in the land but he is WRONG. And if he does not think it was wrong to rewrite the law then he does not belong on the bench. I am open to him demonstrating where the power he exerted is authorized in the Constitution but I doubt he can find it. The Legislative Branch WRITES the laws and the Judicial Branch interprets them to see if they are Constitutional. There is no provision that allows them to rewrite the laws.

Roberts might have done this in an effort to force Obama to defend a huge tax increase and to show he is a liar. He might have done it to make it easier to repeal it. He might have done this to keep the Court from being viewed as political (too late, the ruling was political and not Constitution based) and then again, he might just be a coward.

I don’t know. I think that if he did all these things he might just be a genius by giving Obama defeat while making him think he achieved a victory.

I don’t think this is what courts are supposed to do but the deed has been done and we have to drive on from here.

In 2010 the major issue was Obamacare. The Democrats took a beating because of that ONE issue. They will claim that the economy is what matters to everyone and while that is true does Obama really want to run on that issue?

Those who were not inclined to vote or who were not reliable voters might not have voted based on the economy but they will get out and vote based on Obamacare.

Americans can go through bad times and we know this is part of life. What we will not do is allow government to overreach and to make us slaves to them. That was the message in 2010 and it is the message in 2012.

In November we will take out the trash.

As a last thought, it has always been a joke that if the government could figure a way to tax you for breathing it would. Since we now have to pay a tax for being an American who does not participate in a certain activity it would appear as if government figured out how to tax us just for breathing.

My Evolving Opinion On Roberts

Time has passed since the SCOTUS ruling this morning and I have had a chance to review the opinion of the Court. I still contend that John Roberts participated in judicial activism by calling the penalty a tax when the law, Congress and Barack Obama himself said it was not a tax. It is not up to members of any court to rewrite what a legislative body has written. I am not so sure my earlier claim that Roberts betrayed America is accurate. It feels like a betrayal because he is supposed to uphold the Constitution, not write law but how it feels and what it is are two different things.

But, and this is a big but, he did rule that the Commerce Clause could NOT be used to enact Obamacare (now Obamatax). This is an important thing because it is now settled law that the government cannot compel people to buy things with a Commerce Clause argument.

All along the penalty was seen as a tax by Republicans. Democrats knew it was a tax but could not call it a tax because that would have spelled doom. Obama promised not to tax the middle class and he is on record as saying that people should not get health care by taxing the middle class. So, they had to call it a penalty.

John Roberts, as Chief Justice, was in a precarious position. Liberals were bemoaning the defeat of Obamacare and were all ready with their attacks on the conservative part of the Court. You will notice they never call the four solidly Democrat votes activist, only the conservative votes. in any event, he needed to do something that would uphold conservative principles, reign in government but also give the appearance that the Court is not activist.

Roberts achieved this by declaring that the mandate could not be enacted under the Commerce Clause. That was simple enough and it is sufficient to take the teeth out of future attempts to use Commerce for government expansion.

Roberts, once he asserted that Commerce could not be used to force the mandate acknowledged that Congress had the authority to tax people. He therefore called the penalty a tax which is what it was all along and is what Republicans said from the start.

While I think this amounts to judicial activism I think it was activism that appeared to give the left what it wanted and at the same time smacked them in the head.

Roberts declared that the penalty is a tax. This ruling now means that Obama has enacted the largest tax increase in the history of the world and he did so primarily on the middle class. Roberts gave Obama the outcome he wanted and at the same time demonstrated that Obama is a liar because making this a tax negates the vehement protest Obama made that it was NOT a tax. It also negates his statements that he did not believe everyone should get health care by levying a tax on the middle class.

The ruling also takes away the perception that the Court is political. If Roberts accomplished this while putting the screws to Obama then he is smarter than I originally believed.

He also energized the majority of people in this nation who do not want Obamacare and he gave Mitt Romney a huge gift at the same time. Obama cannot campaign on an activist Court striking down Obamacare but Romney can campaign on Obama being a tax and spend liberal who has given us the biggest tax increase in history. It would appear as if the ruling had a good effect on Romney as his campaign claims to have received about a million dollars in donations just three or four hours post ruling.

I still believe Roberts engaged in judicial activism but I am not as convinced he betrayed the Country. My initial reaction was based on the reports that the mandate was upheld. My belief was that the Commerce Clause argument was allowed to stand and that we could all be forced to buy things under this scheme.

Since this is not how it played out my assessment was hasty and incorrect. I offer an apology to Roberts for my assertion that he betrayed the country.

Like I said, he engaged in judicial activism (which the left is fine with because it went their way) and I am never in favor of that. I believe all branches of government should stay in their own lanes and things will work better.

Time will tell how this plays out and I am interested in seeing how the polls taken after the ruling trend. I think that while liberals celebrate the “victory” they achieved today they are worried because they are aware of what the ruling means for November.

To be sure, Obama (an alleged Constitutional Law Professor) had his mandate ruled unconstitutional. The law was only upheld when the Court changed his penalty to a tax and removed Commerce from the equation. So Obama, in winning, got it wrong. This is not something one would expect from someone who claims to know the Constitution.

I think this ruling might end up being a genius move and might end up costing Democrats. Many lost their seats in 2010 because of Obamacare. That was the only issue on the table and they lost.

Now, millions of seniors and many others who regularly vote as well as those who are opposed to the law and will certainly vote, are energized and will get out to defeat Obama.

The SCOTUS issued its ruling today.

We issue ours in November.

I am praying that we take a lot of seats in the Senate, gain more seats in the House and send Obama back to the street corner where he belongs.

UPDATE: One last note. I read something that is intriguing. Since the Court has ruled this is a tax the Senate only needs 51 votes to overturn it. If Romney wins the presidency and we maintain the House we would only need 51 Senate seats to overturn Obamacare. It could not be blocked by needing 60 votes because it is a tax. I think Roberts might have done us a favor but the rest is up to us. We need to win big.

John Roberts Betrayed This Country

The Chief Justice of the United States became an activist judge along with the liberal justices when they ruled the Individual Mandate in Obamacare as Constitutional. They became activist when they redefined the fee as a tax. Barack Obama and all his Democrat minions said this was NOT a tax and that point was made in the arguments before the Court. Roberts nonetheless, ruled it was a tax and will now go down in history as an activist justice who looked out for his legacy rather than the rule of law in this country.

It is time for the American people to have a second revolution this November and remove every member of Congress who voted for this and to remove Barack Obama for forcing this upon us. This will be our only chance of resolving this issue.

Mitt Romney needs to win the presidency and he needs to repeal Obamacare as he said he would do or we will need to dump him as well. All members who voted for this need to go. We need to make them pay for forcing us to buy things against our will under the guise of calling it a tax.

I have no respect for the presidency and I have no respect for Congress. I also have no respect for the Supreme Court which has become a puppet of government and has ceased being a watchdog for our Constitution.
