		<description>You make a good point Mustang but then again, even if Kentucky did not incorporate the Bill of Rights (I thought all states had) Kentucky could not have a law that affected people in other states.  Also, what if the server is in another state.  

Why would I, in Maryland, be subject to a Kentucky law if I allowed someone with a pen name to comment about someone in Kentucky and it hurt their feelings?

I am sure they have incorporated the provisions or the feds would cut off funding.  What would happen if a state decided not to incorporate the amendment that allowed taxes on personal income?  Would people from that state be allowed to disregard paying federal taxes???

Could we not incorporate the 14th and then ignore the SCOTUS's incorrect interpretation allowing birthright citizenship?

Much to ponder so your approach is best, have a law that restricts idiots from serving...</description>

		<description>I agree that Couch is an idiot, but I'm not sure that such a restriction violates the First Amendement.  The Bill of Rights only applies to citizens when state governments incorporate those provisions, so if Kentucky decided to restrict (not deny) free speech, I think they could do it.  On the other hand, people have been writing under pen names from the beginning, so I doubt if any law could modify this practise in a meaningful way.

This proposed legislation is pure idiocy!  And, of course, it clearly violates First Amendment rights.

I can't imagine that the Kentucky legislature will pass the bill, but stranger things have happened.
