The whole Terrorist Surveillance Program drew fire despite the fact that the process is legal and that status has been upheld by several courts who ruled the President had inherent authority to conduct such operations. Now we have this non-revelation that the NSA is obtaining phone records from major phone companies so they can analyze the data for trends. This too is legal and the law authorizing it, The Communications Assistance for Law Enforcement Act of 1994, signed by none other than Bill Clinton, authorizes the government to get information from phone companies with a court order or other lawful authorization (like from the Attorney General).

This law compels phone companies to comply with the legal requests and if you check out the major phone companies notice of privacy practices you will see that they will release your phone number as well as other requested information to comply with legal requests from the government and law enforcement agencies. They specifically state that information will be released when a legal request is made and the law signed by Clinton allows it to be done.

In addition to this being legal it is also not new information. This story was originally released in December of 2005 by the NYT. It did not get much traction because it was not very newsworthy. The story was re-released as if it were brand new just in time to bring additional attention to the Hayden confirmation hearings. It would appear as if the Drive by Media has an agenda, as usual, and that they are trying to use the hearings to gain a political advantage. The left and its intelligence agency, the DBM, will stop at nothing to derail the process and get all of our secrets out in the open. They truly want us to lose the war and nothing would please them more than for us to be attacked again.

Eugene Robinson of the WaPo is upset about this. He and Patrick Leaky Leahy seem to think this is a new revelation:

“Shame on us, in being so far behind and so willing to rubber-stamp anything this administration does,” said Sen. Patrick Leahy (D-Vt.). He was referring to the Senate, but he could have been speaking for the entire nation.

I guess they were not paying attention in December. Perhaps they were too busy trying to take Christ out of Christmas. In any event, shame on them for not being well informed. One writes for a newspaper and the other is a Senator. One would think they would be on top of things but I guess it is hard to see things when you are blinded by a hatred for the President and anything American. Perhaps instead of speaking for the Senate or the entire nation they ought to learn what they are talking about and speak for themselves instead.
